‎Édition originale de cet essai fascinant sur le duel mêlant le droit et la philosophie politique dû à Auguste Nougarede de Fayet (1811-1853), écrivain et homme politique français. Ce travail très complet fait le bilan critique de la nouvelle législation jugée trop intransigeante et des murs qui entourent le duel. La première partie subdivisée en deux sous-parties est consacrée à létat des lieux de la législation de lépoque, des murs ainsi quaux questions et critiques légitimes de la loi selon lauteur. On peut ainsi y lire à propos du sens de lhonneur des français : [...] nous aurons à faire au système de la Cour de cassation un reproche bien plus grand encore, le plus grand peut-être que lon puisse adresser à un législateur français, cest loubli dans lequel il laisse linstinct généreux de notre caractère, cest lindifférence avec laquelle il foule aux pieds ces sentiments dhonneur et de dignité personnelle qui avaient fait si long-temps la gloire de notre nation.. Lauteur joint à son essai lordonnance de Louis XVI en 1651, le réquisitoire en faveur de la nouvelle législation intransigeante à légard du duel dû à M. Dupin, procureur général, ainsi que larrêt de la cour de cassation du 22 juin 1837. First edition of this fascinating essay on dueling, combining law and political philosophy, by Auguste Nougarede de Fayet (1811-1853), French writer and politician. This comprehensive work provides a critical assessment of the new legislation, which was considered too intransigent, and of the customs surrounding dueling. The first part, divided into two sub-sections, is devoted to an overview of the legislation of the time, customs, and what the author considers to be legitimate questions and criticisms of the law. We can read the following about the French sense of honor: "[...] we will have to make an even greater reproach to the Court of Cassation, perhaps the greatest that can be made to a French legislator, which is the neglect in which it leaves the generous instinct of our character, the indifference with which it tramples on those feelings of honor and personal dignity that have long been the glory of our nation." The author appends to his essay the order of Louis XVI in 1651, the indictment in favor of the new uncompromising legislation on dueling by Mr. Dupin, Attorney General, and the ruling of the Court of Cassation of June 22, 1837. A copy preserved in its original binding of this fascinating essay, which bears witness to the lively social debates of the time.‎
