Trainin gives interesting data: from 1902 to 1908 on average less than 2% of the total number of people were convicted of bankruptcy in Russia and the number of people acquitted on bankruptcy charges was 87.7% while the average rate of acquittals for other crimes was 36.5%. These facts suggested that resolving the case was extremely difficult because all the materials reached the criminal court too late already at the final stage of bankruptcy proceedings. Some scholars argued that it was not possible to give the bankruptcy administration body and the creditors meeting the opportunity to decide on the insolvency characteristic because this means shifting the judicial functions from the state court to the private establishment of bankruptcy which in no way should be allowed.
